1. ACCEPTANCE OF TERMS
Eagle1 Mega Mailer ("WE") provide our service to the member** ("YOU") according to the following Terms of Service("TOS"), which can be changed by us without notice. The most current copy of our TOS can be viewed from the members area at all times.
Furthermore, while you use specific services, you will be subject to such rules or guidelines which pertain to those services. All service specific rules or guidelines shall be considered an extension to the TOS.
2. Limitation of Liability
YOU PURPOSELY UNDERSTAND AND AGREE THAT WE SHALL NOT BE ACCOUNTABLE FOR ANY INDIRECT, DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO GOODWILL, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER HYPOTHETICAL LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE CHANCE OF SUCH DAMAGES), RESULTING FROM: (a) THE USE OF OR THE INABILITY TO USE THE SERVICE; (b) THE COST OF ACQUISITION OF SUBSTITUTE SERVICES AND GOODS FOLLOWING FROM ANY DATA, INFORMATION, GOODS OR SERVICES PROCURED OR OBTAINED OR MESSAGES RECEIVED OR DEALINGS ENTERED INTO THROUGH OR FROM THE SERVICE; (c) FRAUDULENT ACCESS TO OR MODIFICATION OF YOUR TRANSMISSIONS OR DATA; (d) CONDUCT OR STATEMENTS OF A TERTIARY PARTY ON THE SERVICE; OR (e) ANY OTHER ISSUE RELATING TO THE SERVICE.
3. Trademarks and Copyrights
Eagle1 Mega Mailer, eagle1submitter.com, the Eagle1 Mega Mailer logo, and other logos and product and service names are trademarks of Eagle1 Mega Mailer (the "Eagle1 Mega Mailer Marks"). Without Eagle1 Mega Mailer's prior consent, you agree not to brandish or use in any way the Eagle1 Mega Mailer Marks, with the exception of advertising material provided to you by Eagle1 Mega Mailer expressly for the purpose of recruiting new Eagle1 Mega Mailer members. 4. Your Registration Obligations
As a Eagle1 Mega Mailer member you must submit a complete, accurate and truthful profile. If we find the information to be fictitious or misleading, we reserve the right to suspend or terminate your account. It is your responsibility to keep your account current. You also understand that Eagle1 Mega Mailer will send large quantities of emails to the address(es) that you provide. Additionally, if you choose to participate in our Credits to Cash Exchange System, it is very crucial that you keep your account in good standing (i.e. follow the rules and regulations), promote in a professional fashion, and be SPAM FREE!
5. Age Requirements
You agree that you are of legal working age in the state or country in which you reside. Any falsified information will forfeit all your earnings from contests and all credits earned and pending pay outs for cash.
6. Member accounts
You agree to possess only one account per household. Any transaction on your account will be considered an authorized use of our services and Eagle1 Mega Mailer will not be held liable for any violations or unauthorized use of your account. You also agree that, upon discovery of any infractions on your account, you will report them immediately to Eagle1 Mega Mailer staff.
7. Credits To Cash
The option to convert credits earned to cash can be exercised at any time. However, all pay outs will be done the 15th of each month. You, as a member of Eagle1 Mega Mailer, are personally responsible for any tax implications regarding your pay outs. It may include but is not limited to all federal, state and/or self-employment taxes.
8. Refunds
The monthly fee for any of the Upgraded membership (Pro, Premium, Executive) activates your account from the date of your upgrade to the same day the following month. Because we are a credit based safelist, we do not offer refunds. However, YOU do have the right to cancel your subscription at any time.
9. Content Submitted
Eagle1 Mega Mailer does not pre-screen Content, nor do we have ownership of Content which is submitted by you. However, submission of any Content by you constitutes your authorization to publish on publicly accessible areas of the Service. We reserve the right to remove any Content that we deem is harmful, offensive, or inappropriate in any situation. This may include, but is not limited to, Content that infringes on the rights of third-parties or Eagle1 Mega Mailer staff, its users and the public, or Content which is considered offensive or discriminatory under local, state, federal, and international law.
10. No SPAM
You agree that SPAM is unacceptable. Eagle1 Mega Mailer does not tolerate ANY SPAM ACTIVITIES, no if's, and's or buts!! SPAM violations include activities such as unsolicited bulk email, use of any of our Services, Directly or Indirectly, FOR SPAM ACTIVITIES; OR TO PROMOTE SPAM-RELATED PRODUCTS. Once we learn that you are spamming, we will immediately terminate your membership to Eagle1 Mega Mailer without notice and we will not refund any fees.
This is very important so remember, if you DO NOT have consent from the individual to send emails to them, you are deemed in violation of this SPAM POLICY AND YOUR ACCOUNT WILL BE TERMINATED!

11. Rights and Duties on Termination
You recognize that as a member of Eagle1 Mega Mailer, you must understand that we all have to abide by certain rules and regulations. Violations of these terms will not be tolerated and we can and will terminate your account without warning. We reserve the right to terminate or refuse service at our discretion. Eagle1 Mega Mailer may also immediately deactivate or delete your account and all related information and files in your account or the Service. Further, you agree that Eagle1 Mega Mailer is not responsible for any dispute you may have. We are not involved in any kind of trade dispute between you and your members/the 3rd party.
12. Modifications to service
Any change in service, which includes but is not limited to deferment or cease of service, at any given time, will solely be at the discretion of Eagle1 Mega Mailer and is not subject to notification of members. You agree not to hold Eagle1 Mega Mailer legally responsible for any delays in service or interruptions to your account that may result in loss of revenue, opportunity, or business.
13. Indemnity
You agree to hold harmless Eagle1 Mega Mailer and its employees from any claim or demand that has been filed on your behalf by a third party or otherwise. You agree to be solely held accountable for resolving any claims that have developed due to the misuse of our service and/or the violation of our terms of service.
**For the terms of this agreement, 'Member' is defined as one who has signed up for a "Basic" or "Paid" membership, constituting membership in Eagle1 Mega Mailer.
